Elevar, LLC (“Elevar” or “we”) is strongly committed to protecting and respecting your privacy rights. This privacy policy (the “Privacy Policy”) sets out the basis on which Elevar collects and uses information from visitors to our website located at www.getelevar.com (the “Site”) as well as all related websites including our subdomains https://app.getelevar.com and subscribers to our newsletter and applications, and other services provided by us, available through the Site or when you otherwise interact with us online or offline (collectively, together with the Site, our “Service”).

This Privacy Policy also tells you about your rights and choices with respect to data that identifies or can be used to identify you (“Personal Information”), and how you can reach us to update your contact information or get answers to questions you may have about our privacy practices.

Registration with, use of, and access to the Service is subject to this Privacy Policy and our Terms of Use located at https://getelevar.com/terms. All terms not defined in this Privacy Policy will have the meanings set forth in the Elevar Terms of Service.

This Privacy Policy applies when Elevar acts as the data controller of your information. However, this Privacy Policy does not cover information that Elevar collects and processes about end users of our entity customers (“Customer Users”) on behalf of such customers, in connection with the services provided by Elevar to customers pursuant to an applicable Master Services Agreement (“Customer Data”). Elevar processes Customer Data and other information of Customer Users under the instructions of the relevant customer as the “data controller” or similar role as defined in applicable privacy laws, as described in the applicable agreement entered into by such customer and Elevar. Elevar’s obligations as a “data processor” or “service provider” with respect to such information are defined in such services agreement, and are not made part of this Privacy Policy. If you are a Customer User and you have questions about how your information is collected and processed through the Elevar services, please contact the customer who has provided your information to us for more information.

1. What Personal Information is collected?

We obtain Personal Information relating to you from various sources described below.

Where applicable, we indicate whether and why you must provide us with your Personal Information, as well as the consequences of failing to do so. If you do not provide Personal Information when requested, you may not be able to benefit from our Service if that information is necessary to provide you with the Service or if we are legally required to collect it.

2. Personal Information provided by you

  • Registration: If you desire to have access to certain restricted sections of the Site or request to receive marketing materials, you may be required to become a registered user and submit the following types of Personal Information to Elevar: your name, email address, phone number, full user name, password, and time zone.
  • Conferences and Events: We may collect information when you register for or attend our conferences or industry events, or otherwise interact with us at other conferences or industry events. This information may include your name, company name, website URL, job title, email address, phone number, city/state location, and dietary preferences and needs to help us provide appropriate accommodations.
  • Customer Support: We may collect information through your communications with our customer support team and services or other communications that you may send us and their contents.
  • Making a Purchase: When you make payments through the Service, you will need to provide Personal Information such as your credit card number and billing address.
  • Data Sources: In order to authenticate your data sources (like Google Analytics), we may ask you to provide your username, account IDs, and email address. You are given the option to select the data sources which you would like the Service to authenticate.
  • Other: We may also collect your contact details when you provide them in the context of our customer, vendor, and partner relationships.

3. Are Cookies and Log files used?

  • Log Data: When you use our Service, our servers automatically record information that your browser sends whenever you visit a website (“Log Data”). This Log Data may include information such as your IP address, browser type or the domain from which you are visiting, the web pages you visit, the search terms you use, and any advertisements on which you click.
  • Cookies and Similar Technologies: Like many websites, we and our partners also use “cookie” technology to collect additional website usage data and to improve the Site and our Service. A cookie is a small data file that we transfer to your computer’s hard disk. A session cookie enables certain features of the Site and our service and is deleted from your computer when you disconnect from or leave the Site. 4. Uses made of Personally Identifiable Information

Elevar may use information collected from you for the following purposes:

  • For direct marketing campaigns, as permitted by law; Elevar will give you the option to opt out of each commercial email communication that it sends to you;
  • To provide you with information and services that you request from Elevar or which Elevar feels may interest you, where you have consented for such purposes;
  • To customize the Service to your preferences;
  • To provide you with services available through the Service, for which you register;
  • To register you for a conference or event and administer, operate, and secure such conferences and events;
  • To develop new features of the Service and services available through the Service, and for testing and other development purposes that do not involve disclosure to third parties;
  • To carry out Elevar’s obligations under any contracts with you;
  • To allow you to participate in interactive features of the Service, when you choose to do so;
  • To notify you about the changes to the Service or any services available through the Service, including new product announcements;
  • To conduct internal administration of Elevar’s business; and
  • To comply with applicable legal requirements, industry standards, and our policies.

Aggregate/De-Identified Information

We may aggregate and/or de-identify any information collected through our Service so that such information can no longer be linked to you or your device (“De-Identified Information”). We may use De-Identified Information for any purpose, including without limitation for research and marketing purposes, and may also disclose such data to any third parties, including advertisers and business partners.

Combined Information

We may combine the information that we collect through the Service with information that we receive from other sources, both online and offline, and use such combined information in accordance with this Privacy Policy.

Legal Bases for Processing

If you are located in the European Economic Area, we may process your Personal Information for the above purposes when:

  • You have consented to the use of your Personal Information (for example, we may seek to obtain your consent for our use of cookies or similar technologies, or to send you marketing communications);
  • We need your Personal Information to provide you with services and products requested by you, or to respond to your inquiries;
  • We have a legal obligation to use your Personal Information; or
  • We have a legitimate interest in using your Personal Information. In particular, we have a legitimate interest in using your Personal Information to ensure and improve the safety, security, and performance of our Service, to anonymize Personal Information and carry out data analyses.

5. Does Elevar disclose Personal Information to Third Parties?

We may disclose the Personal Information we collect about you as described below or otherwise disclosed to you at the time the data is collected, including with:

Service Providers

We engage certain trusted third parties to perform functions and provide services to us, including hosting and maintenance, error monitoring, debugging, performance monitoring, billing, customer relationship, database storage and management, and direct marketing campaigns. We may also engage a third party to host or operate any aspect of the Service, including any mechanism through which we send or receive communications, such as our email systems and our Site. We may disclose your Personal Information to these third parties, but only to the extent necessary to perform these functions and provide such services. We also require these third parties to maintain the privacy and security of the Personal Information they process on our behalf.

Other Third Parties

We may disclose Personal Information with our headquarters and affiliates, and business partners to whom it is reasonably necessary or desirable for us to disclose your data for the purposes described in this Privacy Policy. We may also make certain Personal Information available to third parties for various purposes, including for business or marketing purposes or to assist third parties in understanding our users’ interest, habits, and usage patterns for certain programs, content, services, advertisements, promotions, and functionality available through the Service.

  • In the event that Elevar sells or buys any business or assets, in which case Elevar may disclose your Personally Identifiable Information to the prospective seller or buyer of such business or assets;
  • If Elevar or substantially all of its assets are acquired by a third party, in which case Personally Identifiable Information held by it about its customers may be one of the transferred assets;
  • If Elevar is under a duty to disclose your Personal Information in order to comply with any legal obligation; or
  • To protect the rights, property, or safety of Elevar or its customers, which includes exchanging information with other companies and organizations for the purposes of fraud protection and credit risk reduction.
  • We may share your Personal Information with other third parties if you provide consent for us to do so.

6. Data analytics and benchmarking

We may use information generated and stored during your use of our Service or other services for our legitimate business interests to enable us to give you the best Service, other services, and/or solutions and the best experience. These purposes include:

  • Delivering advertising, marketing (including in-product messaging) or information to you which may be useful to you, based on your use of the Service;
  • Whenever we use your information for our legitimate interests, we will ensure that your information is processed and displayed at aggregated levels, which will not be linked back to you or to any living individual;

7. Securing and retaining your Personal Information

Elevar is very concerned about safeguarding the confidentiality of your Personal Information. Elevar takes reasonable steps to protect your Personally Identifiable Information as you transmit such information from your computer to the Service, and to protect such information from loss, misuse, and unauthorized access, disclosure, alteration, or destruction. You should keep in mind, however, that no internet transmission is 100% secure or error-free. In particular, e-mail sent to or from the Service may not be secure, and you should therefore take special care in deciding what information you send to the Service via e-mail or other electronic means. Where Elevar has given you a username and/or password which enables you to access certain parts of the Service, you are responsible for keeping such username and/or password confidential.

We will make any legally-required disclosures of any breach of the security, confidentiality, or integrity of your unencrypted electronically stored Personal Information to you via email or conspicuous posting on our Site in the most expedient time possible and without unreasonable delay, consistent with (i) the legitimate needs of law enforcement or (ii) any measures necessary to determine the scope of the breach and restore the reasonable integrity of the data system, and any other disclosures that may be required under applicable law.

We also take measures to delete your Personal Information or keep it in a form that does not permit identifying you when this information is no longer necessary for the purposes for which we process it, unless we are required by law to keep this information for a longer period. When determining the retention period, we take into account various criteria, such as the type of products and services requested by or provided to you, the nature and length of our relationship with you, possible re-enrollment with our products or services, the impact on the services we provide to you if we delete some information from or about you, mandatory retention periods provided by law, and the statute of limitations.

8. Advertising and Online Analytics Technologies Used

As described in “Cookies and Similar Technologies” above, as you use our Service, we, our service providers, and ad and analytics partners collect a variety of information through the use of “cookies” and similar technologies, such as tracking pixels, to understand how you navigate through and interact with our Service, to learn what content is popular, to enhance the Services and provide you with a more relevant and personalized experience, for authentication and advertising purposes, to save your preferences, and to collect certain usage, device, and location information as described above.

Google Analytics and Other Online Analytics Providers

Tailored Online Advertising

In using the Services, we allow select third-party advertising technology partners to place cookies or other tracking technologies on the browser of your device to collect information about you as discussed above. 9. Data transfers & European Economic Area

Elevar is based in the United States. Personal Information that we collect may be transferred to, and stored at, any of our affiliates, partners, or service providers which may be inside or outside the European Economic Area (“EEA”) and Switzerland, including the United States. By submitting your Personal Information (also called “personal data” under laws in the EEA), you agree to such transfers. Your Personal Information may be transferred to countries that do not have the same data protection laws as the country in which you initially provided the information. When we transfer or disclose your Personal Information to other countries, we will protect that information as described in this Privacy Policy.

European Economic Area

Personal information in the European Union is protected by data protection laws but other countries do not necessarily protect your Personal Information in the same way.

We take steps to ensure that when your information is transferred outside of the EEA by our service providers and hosting providers, appropriate measures and controls are in place to protect that information in accordance with applicable data protection laws and regulations. 10. Children’s privacy

We do not knowingly collect information from children under the age of 16 through the Service. If you are under the age of 16, please do not provide any information through the Service. Rights Regarding Your Information

We may also follow up with you to verify your identity before processing the authorized agent’s request as permitted by applicable law. Depending on applicable law, you may have the right to appeal our decision to deny your request, if applicable. We will provide information about how to exercise that right in our response denying the request. You also have the right to lodge a complaint with a supervisory authority.

If you are a Customer User and your information has been collected by us as a result of a customer’s use of the Service pursuant to a Master Services Agreement between us and the customer, we collect and process any information of yours under the directions of the relevant customer. If these circumstances apply to you and you wish to access, edit, delete, or exercise any rights you may have under applicable data protection laws with respect to any information that we have collected about you, please direct your query to the relevant customer, as this may expedite the completion of your request. We nevertheless provide reasonable assistance to our customers to give effect to data subject rights as appropriate and required by applicable laws.

Notice of Right to Opt Out of Sales of Personal Information and Processing/Sharing of Personal Information for Targeted Advertising Purposes

Depending on your jurisdiction, you may also have the right to opt out of “sales” of your information and “sharing/processing of your information for targeted advertising.”

As explained in the “Does Elevar Disclose Personally Identifiable Information to Third Parties?” section above, we may provide information to third-party advertising providers for targeted advertising purposes or use advertising analytics partners to assist us in analyzing use of our services and our user/customer base. Under applicable law, the disclosure of your personal information to these third parties to assist us in providing these services may be considered a “sale” of personal information or the processing/sharing of personal information for targeted advertising purposes.

13. California privacy rights

Opt-Out of Sale/Sharing of Personal Information

The CCPA sets forth certain obligations for businesses that “sell” personal information or “share” personal information for cross-context behavioral advertising purposes. Under the CCPA, “sale” and “sharing” are defined such that they may include allowing third parties to receive certain information for advertising purposes.

If you would like to opt out of our use of your personal information through cookies and similar online tools for such purposes that are considered a “sale” or “sharing” for cross-context behavioral advertising purposes under California law (as indicated in the chart above), please visit the “Your Privacy Choices” link in the footer of our website. In the limited circumstances that we process sensitive personal information as defined in the CCPA (e.g., log-in information), we do not use or disclose it other than for disclosed and permitted business purposes for which there is not a right to limit under the CCPA.

Shine the Light

California Law permits customers who are California residents to request certain information once per year regarding our disclosure of “personal information” (as that term is defined under applicable California law) to third parties for such third parties’ direct marketing purposes. We do not disclose personal information to third parties for their own direct marketing purposes without your consent.

Do Not Track

Do Not Track (“DNT”) is a privacy preference that users can set in certain web browsers. DNT is a way for users to inform websites and services that they do not want certain information about their webpage visits collected over time and across websites or online services. Except as otherwise described herein with respect to legally required browser-based opt outs, we do not recognize or respond to browser-initiated DNT signals, as there is no industry-wide framework for DNT signals.
